The Declaration of Human Rights was created by country officials from all over the world. Some of authors of the Declaration of Human Rights were the wife of president Franklin Roosevelt; Eleanor Roosevelt, P.C. Chang (an official from China,) and John Humphrey (Canada.) They and other peace lovers of this world created a declaration to ensure that all and every human has a safe life by having countries sign this declaration to give all humans their article of The Declaration of Human Rights. Entitled to at the bare minimum. The Declaration of Human Rights is made up of 30 articles to ensure that every person on this world has the rights to live and prosper. Our group was assigned the 16th.
The article 16 of the Declaration of Human Rights states that everyone has the right to marry anybody they so choose (as long as they have the full consent of the other partner) and can not be restricted or limited to marring certain people because of their race, nationality, or religion.
The last statement of the 16th article says that since the family is a part of society, and is needed in the chain of society, that family in entitled to protection by the society and or State that they live in.” This means that if protection is needed, the society and state/country that they live in must protect them because it is a human right to have this protection and the society and/ or state/country can not deny it to the family. This article has a few big loop holes such as:
- If family seeks protection from the state or country the society which they live in must offer protection, but the amount of protection and the type of protection are not listed or talked about allowing for states/countries or societies to deny adequate protection because the inadequate protection they gave is protection none the less. It also states that they get protection but doesn’t state from what, and what kinds of attacks that they get protection from.
- Gay marriage is not talked about in this declaration in any way. It says that no matter what race, nationality,or religious views you are or have you can still get married to whom every you like. It basically says that you can marry anyone you want, but leaves the decision to have gay marriage legal, or illegal up to the state/country/society they live in. This makes this article sort of a oxymoron because it says that your rights are that you can marry whom ever you choose (as long as there is full consent to this marriage from both party's) not matter what they or where you live unless they are the same gender as you and you live in a place that does not allow that. It is an unfair law that makes it so that same sex marriage can be and is the only thing that can be (other than under age marriage) illegal. In the United States of America five states allow same sex marriage, these states are Connecticut, Iowa, Massachusetts, Vermont, and the District Of Columbia. Eight states in the United States of America allow something called a registered partnership. This means that the states don’t have to say that they are for same sex marriage, but they can still please the gay community by giving them a registered partnership which allows them to have the same financial benefits as a married couple, but they actually are not married. These eight states are California, Hawaii, Maine, New Jersey, New York, Nevada, Oregon, and Rhode Island. Out of fifty states in the United States of America, only thirteen allow either gay marriage or registered marriages.This article has many loop holes, but it does have many purposes such as to protect against forced marriages.
Forced marriage is when two people become family with no consent or agreeing to marry. An arranged marriage is when two families set up for their children to be wed. The difference between the two is forced against a person’s will and arranged is a agreement that is close to not being a free will of marriage because you could lose the respect of their parents or whom ever arranged the marriage. The 16th article of the Declaration of Human Rights protects against forced marriage because forced marriage violates the 16th article of the Declaration of Human Rights because one person in the marriage has not submitted to this marriage with full consent. For example, every year 1,000 British and Europeans girls, mostly in their teens, are send to Islamic Countries Pakistan, India, Yemen, Algeria to visit their relatives, once they get there they found out that they have been secretly married with a man they haven't meet. Many of these girls are taken to remote villages where there is no way to escape. They have no connection to post office or a telephone to look for help. Most of the girls end up being rape or beaten up by their “husband” whom is basically their buyer.These extreme cases have a small percentage to force marriages now a days which takes place in Europe. Even though these girls are European citizens they don’t receive enough protection from the European government and local authorities when they don’t remain the girls’ family decision.
